Terms of Service
Effective date: September 16, 2026
These Terms of Service (“Terms”) govern your access to and use of Amptionary, including its website, accounts, subscriptions, AI-generated guitar-tone guidance, song library, and related services (collectively, the “Service”). Amptionary is operated by Adam Samakovlis (“Amptionary,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must approve your use. You agree to provide accurate account information, protect your login credentials, and accept responsibility for activity under your account. Contact us promptly if you believe your account has been compromised.
2. The Service
Amptionary provides informational tools that translate reference guitar tones into suggested settings for a user’s guitar, amplifier, pedals, and related equipment. Features and available content may change as the Service develops.
3. AI results and equipment disclaimer
AI-generated and library-based tone recommendations are informed estimates, not guarantees of an exact match. Results may vary based on the recording, instrument, pickups, amplifier, effects, speakers, room, technique, volume, and other factors. You are responsible for reviewing settings before using them. Begin at a safe volume and follow all manufacturer instructions. Amptionary is not responsible for hearing damage, equipment damage, performance outcomes, or other harm caused by unsafe or improper use.
4. Acceptable use
You may use the Service for personal or lawful commercial music-making purposes. You may not misuse the Service; interfere with its operation or security; access another person’s account; scrape, copy, resell, reverse engineer, or systematically extract the Service or its databases; evade search limits or payment requirements; submit unlawful or infringing material; or use automated systems without our written permission.
5. Subscriptions and billing
Paid plans renew automatically at the interval shown during checkout until canceled. Prices, features, and usage limits are displayed before purchase and may change prospectively. Payments are processed by Stripe. You authorize the applicable recurring charges and are responsible for current billing information, taxes, and fees. You may cancel through any available billing-management tool or by contacting adam@amptionary.com. Cancellation stops future renewals but normally does not end access already paid for.
6. Refunds
Refund eligibility is governed by our Refund & Cancellation Policy, which is incorporated into these Terms. A customer may request a refund of their first subscription payment within seven calendar days of that charge. Renewal payments are normally nonrefundable except where required by law or expressly stated in that policy.
7. Intellectual property
The Service, Amptionary name and branding, software, design, original text, databases, and original materials are owned by Amptionary or its licensors and are protected by applicable laws. These Terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service. Song titles, artist names, trademarks, recordings, tablature, lyrics, and third-party materials remain the property of their respective owners. Reference to them does not imply sponsorship or endorsement.
8. Third-party services and links
The Service may use or link to third parties such as Stripe, Supabase, OpenAI, Cloudflare, YouTube, and external chord or tablature providers. Their services are governed by their own terms and privacy policies. We do not control and are not responsible for third-party content, availability, security, or practices.
9. Availability and changes
We may update, suspend, limit, or discontinue any part of the Service; correct errors; enforce usage limits; or modify these Terms. We do not guarantee uninterrupted or error-free access. Material changes will be posted with an updated effective date.
10. Suspension and termination
We may suspend or terminate access when reasonably necessary to protect the Service, comply with law, prevent fraud or abuse, address nonpayment, or enforce these Terms. You may stop using the Service at any time. Provisions that should reasonably survive termination will continue to apply.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, merchantability, title, and noninfringement. Nothing in these Terms limits rights that cannot lawfully be waived.
12. Limitation of liability
To the fullest extent permitted by law, Amptionary and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, lost profits, business interruption, or damage arising from equipment use, third-party services, or reliance on tone recommendations. Our aggregate liability for a claim relating to the Service will not exceed the amount you paid to Amptionary during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
13. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction located in New York, subject to applicable consumer-protection law.

These policies are provided for general business use and do not constitute legal advice. Amptionary may have them reviewed and updated by a qualified attorney as the business grows.
